NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 28th day of July, 2015, and entered in Case No. 14005181CI, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein THE BANK OF NEW YORK, AS INDENTURE TRUSTEE FOR THE ENCORE CREDIT RECEIVABLES TRUST 2005-2 is the Plaintiff and ALBERT MARTIN A/K/A ALBERT D. MARTIN AKA ALBERT DOUGLAS MARTIN; CAPITAL ONE BANK (USA), NATIONAL ASSOCIATION F/K/A CAPITAL ONE BANK; EAST LAKE WOODLANDS CLUSTER HOMES IMPROVEMENT ASSOCIATION UNIT FIVE, INC.; EAST LAKE WOODLANDS CLUSTER HOMES IMPROVEMENT ASSOCIATION, INC.; EAST LAKE WOODLANDS COMMUNITY ASSOCIATION, INC.; YHT AND ASSOCIATES, LLC, TRUSTEE OF THE 50 LANCE CT LAND TRUST UNDER AGREEMENT DATED SEPTEMBER 18, 2012; THEDA R. MEYER; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 26th day of October, 2015, at 10:00 AM on Pinellas County's Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
LOT 68, EAST LAKE WOODLANDS CLUSTER HOMES UNIT FIVE, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 82, PAGES 70 THROUGH 73, OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
