NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure dated December 12, 2014 entered in Case No. 2011 CA 002608 NC of the Circuit Court of the Twelfth Judicial Circuit, in and for Sarasota County, Florida, wherein OneWest Bank, FSB is the Plaintiff and Ronald H. Layendecker; Unknown Spouse of Ronald H. Layendecker; if Living, Including any Unknown Spouse of said Defendant(s), if Remarried, and if Deceased, the Respective Unknown Heirs, Devisees, Grantees, Assignees, Creditors, Lienors, and Trustees and all other persons claiming by, through, under or against the named Defendant(s); Ford Motor Credit Company, a Dissolved Corporation; Whether Dissolved or Presently Existing, Together with any Grantees, Assignees, Creditors, Lienors, or Trustees of Said Defendant(s) and All other Persons Claiming By, Through, Under, or Against Defendant(s); Unknown Tenant #1; Unknown Tenant #2 are the Defendants, that the Clerk of Courts will sell to the highest and best bidder for cash by electronic sale at www.sarasota.realforeclose.com, beginning at 9:00 AM on the 20th day of January, 2015, the following described property as set forth in said Final Judgment, to wit:
LOT 41, ARTIST ACRES, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 6, PAGE 5, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA. TOGETHER WITH THE SOUTH 1/2 OF THE HIATUS BETWEEN LOTS 40 AND 41, ARTIST ACRES, SARASOTA COUNTY, FLORIDA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: A PARCEL OF LAND LYING BETWEEN LOTS 40 AND 41, ACCORDING TO THE PLAT OF “ARTIST ACRES” AS RECORDED IN PLAT BOOK 6 AT PAGE 5 OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 41; THENCE NORTH 89°37'18” WEST, ALONG THE NORTHERLY LINE OF SAID LOT 41 A DISTANCE OF 229.97 FEET TO THE NORTHWEST CORNER OF SAID LOT 41 AND TO A POINT ON THE EASTERLY LINE OF LOT 39 OF THE SAID PLAT OF “ARTIST ACRES”; THENCE NORTH 00°21 '48” WEST, ALONG THE EASTERLY LINE OF SAID LOT 39 A DISTANCE OF 11.20 FEET; THENCE SOUTH 89°35'08” EAST, A DISTANCE OF 230.00 FEET TO THE INTERSECTION WITH THE WESTERLY RIGHT OF WAY LINE OF NORTH ELM STREET. THENCE SOUTH 00°10'45” EAST, A DISTANCE OF 11.06 FEET TO THE POINT OF BEGINNING AND CONTAINING 2,560 SQUARE FEET, MORE OR LESS.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
