NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated April 7, 2015, and entered in Case No. 2013 CA 000135 NC, of the Circuit Court of the 12th Judicial Circuit in and for SARASOTA County, Florida, wherein THE BANK OF NEW YORK MELLON, AS TRUSTEE, FOR CIT MORTGAGE LOAN TRUST 2007-1 is Plaintiff and ALL UNKNOWN HEIRS, CREDITORS, DEVISEES, BENEFICIARIES, GRANTEES, ASSIGNEES, LIENORS, TRUSTEES, AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER OR AGAINST THE ESTATE OF ROBERT D. MCVEY, DECEASED; UNKNOWN SPOUSE OF ROBERT D. MCVEY N/K/A CYNTHIA MCVEY; CYNTHIA MCVEY, AS PERSONAL REPRESENTATIVE IN RE THE ESTATE OF ROBERT D. MCVEY; KIMBERLY DAWN HAYDEN; TRACI PETER; JENNIFER MCVEY; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; THE COLONY AT SABAL TRACE CONDOMINIUM ASSOCIATION, INC.; SABAL TRACE MASTER ASSOCIATION, INC.; are defendants. The Clerk of Court will sell to the highest and best bidder for cash BY ELECTRONIC SALE AT: WWW.SARASOTA.REALFORECLOSE.COM, at 9:00 A.M., on the 8 day of June, 2015, the following described property as set forth in said Final Judgment, to wit:
UNIT 102, BUILDING 5762, THE COLONY AT SABAL TRACE, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS INSTRUMENT # 2005115527, AS AMENDED IN OFFICIAL RECORDS INSTRUMENT # 2005132220, AND ACCORDING TO CONDOMINIUM BOOK 37, PAGES 49 THROUGH 49G, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, TOGETHER WITH THAT LIMITED COMMON ELEMENT GARAGE 62-3 AND PARKING SPACE 62-3, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
