YOU ARE NOTIFIED that an action to quiet title on the following described property:
Lot Fifteen (15), CLEARVIEW OAKS UNIT ONE, according to a plat thereof recorded in plat book 59, page 61, Public Records of Pinellas County, Florida. Excepting, however, therefrom any and all buildings and improvements of any nature located on said land beyond the portion and part of said buildings and improvements herein-after specifically included;
Together with that certain apartment located on said land above described consisting of approximately 1100 square feet, known and designated as APARTMENT NUMBER 419 and so designated on the entrance door of said apartment, and as said apartment is shown on the “Apartment Unit Plan” attached to deed dated December 9, 1963, recorded in O.R. 1818, on page 60, Public Records of Pinellas County, Florida, wherein Merna Land Company is Grantor, and together withal interest in carport, hot water, garbage receptacle, storage, and air conditioning, as is more particularly shown on said “Apartment Unit Plan”.
The inside surface of the walls of said Apartment Number 419 shall determine the perimeter line as concerns any portion of the building herein-conveyed, together with an undivided one-eight (1/8) interest in and to the walls and other structural supports necessary for said building.
This conveyance and the rights conveyed hereunder expressly includes a right of way for ingress and egress to and from said apartment and all accessories appertaining thereto, and also the right of use of public halls, public rooms, public passageways, public lavatories, public toilets, and all other public portions and equipment of said building in common with the other occupants thereof, together with an easement which shall be perpetual and shall pass with each conveyance of said Apartment Number 419 herein mentioned, referred to, or incorporated in any future conveyance for the use and enjoyment of that part of the general real estate herein described, and the use and enjoyment of public areas as shown on said “Apartment Unit Plan”, excepting, however, that the interest herein conveyed is a common interest with all other owners of apartments/condominiums erected on the said general real estate.
The conveyance is subject to the Management Agreement made and entered into by and between COMI (Clearview Oaks Management, Inc.) and the Grantees herein, dated November 21, 1963, with concomitant revisions and said agreement and the terms thereof shall be binding upon the Grantee herein, their heirs, successors, assigns, executors, and subsequent Grantees herein, such agreement being included or referred to in any subsequent conveyances.
