NOTICE OF SALE IS HEREBY GIVEN pursuant to the order of Uniform Final Judgment of Foreclosure dated June 9, 2016, and entered in Case No 2012-CA-007687 of the Circuit Court of the 6th Judicial Circuit in and for Pinellas County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWMBS, INC. CHL MORTGAGE PASS-THROUGH TRUST 2004-12 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2004-12, is Plaintiff and RODNEY B. GERBERS, ET. AL., are the Defendants, the Office of Ken Burke, Pinellas County Clerk of the Court will sell to the highest and best bidder for cash via an online auction at www.pinellas.realforeclose.com at 10:00 A.M. on the 12th day of September, 2016 the following described property as set forth in said Final Judgment, to wit:
Lot 38, BALINTORE, according to the map or plat thereof, as recorded in Plat Book 111, Page 66 through 68, of the Public Records of Pinellas County, Florida.
Property Address: 3715 Doral Street, Palm Harbor, FL 34685
and all fixtures and personal property located therein or thereon, which are included as security in Plaintiff's mortgage.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
