NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated September 8, 2016, entered in Case No. 2008 CA 007522 of the Circuit Court of the Twelfth Judicial Circuit, in and for Sarasota County, Florida, wherein Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc. Trust 2006-HE3 is the Plaintiff and Suzanne L Smith; The Unknown Spouse of Suzanne L. Smith if any; Any and All Unknown Parties Claiming by, Through, Under and Against the Herein Named Individual Defendant(s) who are not Known to be Dead or Alive, Whether said Unknown Parties may Claim an Interest as Spouses, Heirs, Devisees, Grantees, or other Claimants; Mortgage Electronic Registration Systems Inc; John Doe and Jane Doe as Unknown Tenants in Possession are the Defendants, that Karen Rushing, Sarasota County Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.sarasota.realforeclose.com, beginning at 9:00 AM on the 6th day of January, 2017, the following described property as set forth in said Final Judgment, to wit:
BEGIN AT THE COMMON CORNER OF LOTS 10 AND 11, BLOCK 6, AND THE NORTHWESTERLY RIGHT OF WAY OF COLUMBUS BOULEVARD, AS PER PLAT OF MIRAMAR BEACH, RECORDED IN PLAT BOOK 2, PAGES 130 AND 130A, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA; THENCE NORTH 45 DEGREES 29 SECONDS WEST, ALONG THE LOT LINE BETWEEN LOTS 10 AND 11, OF SAID BLOCK 6.65 FEET TO AN IRON PIPE FOR A P.O.B., THENCE NORTH 58 DEGREES 13 SECONDS EAST, 105.5 FEET TO AN IRON PIPE ON THE NORTHEASTERLY LINE OF LOT 9; THENCE NORTHWESTERLY ALONG THE NORTHEASTERLY LOT LINE AND AVENIDA VENETIA 56.45 FEET TO A POINT WHICH IS 10 FEET NORTHWESTERLY FROM THE EAST CORNER OF LOT 8, BLOCK 6; THENCE SOUTHWESTERLY TO A POINT OF THE SOUTHWESTERLY LOT LINE OF LOT 9, BLOCK 6, WHICH POINT IS SOUTH 45 DEGREES 29 SECONDS EAST, 10 FEET FROM THE WEST CORNER OF LOT 9. THE LAND SO DESCRIBED BEING PARTY OF LOTS 8, 9, AND 10, BLOCK 6, MIRAMAR BEACH SUBDIVISION, RECORDED IN PLAT BOOK 2, PAGES 130 AND 130A, OF SAID RECORDS OF SARASOTA COUNTY, FLORIDA.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
