NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Summary Judgment. Final Judgment was awarded on April 15, 2016 in Civil Case No. 36-2012-CA-053860, of the Circuit Court of the TWENTIETIH Judicial Circuit in and for Lee County, Florida, wherein, DEUTSCHE BANK NATIONAL TRUST COMPANY AS TRUSTEE UNDER THE POOLING SERVICE AGREEMENT DATED AS OF FEBRUARY 1, 2007. FOR GSAMP TRUST 2007-FM2, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-FM2 is the Plaintiff, and JUDITH K MASSING; LAWRENCE B MASSING; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The clerk of the court, Linda Doggett will sell to the highest bidder for cash www.lee.realforeclose.com on August 15, 2016 at 9:00 AM; the following described real property as set forth in said Final Summary Judgment, to wit:
A LOT OR PARCEL OF LAND LYING WEST 340 FEET OF SECTION 32, TOWNSHIP 43 SOUTH, RANGE 25 EAST, LEE COUNTY, FLORIDA, WHICH LOT OR PARCEL IS DESCRIBED AS FOLLOWS:
BEGINNING AT A STEEL PIN MARKING THE NORTHWEST CORNER OF SAID SECTION 32; THENCE RUN SOUTH 00 DEGREES 01' 06” EAST ALONG THE WEST LINE OF SAID SECTION 32 FOR 339.57 FEET; THENCE RUN SOUTH 89 DEGREES 15' EAST. PARALLEL WITH THE NORTH LINE OF SAID SECTION 32 FOR 182.52 FEET TO A STEEL PIN PASSING OVER A STEEL PIN AT 25.01 FEET; THENCE RUN NORTH 00 DEGREES 01' 06” WEST PARALLEL WITH THE WEST LINE OF SAID SECTION FOR 339.57 FEET, PASSING OVER 3/4 INCH PIPE AT 306.57 FEET, TO THE NORTH LINE OF SAID SECTION 32; THENCE RUN NORTH 89 DEGREES 15' WEST ALONG SAID NORTH LINE FOR 182.52 FEET TO THE POINT OF BEGINNING. SUBJECT TO EASEMENTS FOR DONALD ROAD OVER AND ACROSS THE NORTH 33 FEET AND JONES ROAD OVER AND ACROSS THE WEST 25 FEET. BEARING HEREIN ABOVE MENTIONED ARE BASED ON A MAGNETIC BEARING OF SOUTH 89 DEGREES 15' EAST ALONG THE NORTH LINE OF SAID SECTION 32.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
