NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Judgment. Final Judgment was awarded on May 17, 2016 in Civil Case No. 16-000606-CI, of the Circuit Court of the SIXTH Judicial Circuit in and for Pinellas County, Florida, wherein, DITECH FINANCIAL LLC FKA GREEN TREE SERVICING LLC is the Plaintiff, and DAVID K. FORKER; ALL PHASE PAVING AND SEALING; GATEWAY BY THE BAY CONDOMINIUM ASSOCIATION, INC.; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The clerk of the court, Ken Burke will sell to the highest bidder for cash at www.pinellas.realforeclose.com on July 1, 2016 at 10:00 AM, the following described real property as set forth in said Final Judgment, to wit:
THAT CERTAIN CONDOMINIUM PARCEL COMPOSED OF UNIT 124 AND AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH, AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, EASEMENTS, TERMS AND OTHER PROIVISIONS OF THE DECLARATION OF CONDOMINIUM OF GATEWAY BY THE BAY, A CONDOMINIUM, AND EXHIBIT ATTACHED THERETO, ALL AS RECORDED IN PLAT THEREOF AS RECORDED IN CONDOMINIUM PLAT BOOK 49, PAGES 119 THROUGH 124, INCLUSIVE, BOTH OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
