NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated October 8, 2015 and entered in Case No. 14-CA-050525 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein BANK OF AMERICA N.A. is the Plaintiff and RICHARD BEAUDRY, STACI BEAUDRY, INVESTOR TRUSTEE SERVICE, LLC, WELLS FARGO SUCCESSOR BY MERGER TO WACHOVIA BANKC, N.A, and MARK SAUGER the Defendants. Clerk of the Circuit Court in and for Lee County, Florida will sell to the highest and best bidder for cash at www.lee.realforeclose.com, the Clerk's website for on-line auctions at 9:00 am on 7 day of December, 2016, the following described property as set forth in said Order of Final Judgment, to wit:
LOTS 26 AND 27, BLOCK 4571, UNIT 68, CAPE CORAL SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 23, PAGE 100 THROUGH 108, INCLUSIVE, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
