All creditors of the decedent and the other persons having claims or demands against decedent's estate on whom a copy of this notice is required to be served must file their claims with this court WITHIN THE LATER OF 3 MONTHS AFTER THE TIME OF THE FIRST PUBLICATION OF THIS NOTICE OR 30 DAYS AFTER THE DATE OF SERVICE OF A COPY OF THIS NOTICE ON THEM.
All other creditors of the decedent and other persons having claims or demands against decedent's estate must file their claims with this court WITHIN 3 MONTHS AFTER THE DATE OF THE FIRST PUBLICATION OF THIS NOTICE.
ALL CLAIMS NOT FILED WITHIN THE TIME PERIODS SET FORTH IN SECTION 733.702 OF THE FLORIDA PROBATE CODE WILL BE FOREVER BARRED.

The administration of the estate of VERA. M. KAMINSKI, deceased, whose date of death was June 22, 2016 and whose social security number is xxx-xx-5427, is pending in the Circuit Court for Lee County, Florida, Probate Division, the address of which is Justice Center, 2nd Floor, 2075 Dr. Martin Luther King Junior Boulevard, Ft. Myers, Florida 33901; mailing address: Lee County Circuit Clerk -Probate, P.O. Box 9346, Ft. Myers, Florida 33902. The names and address of the Petitioner and the Petitioner's attorney are set forth below.
The estate is intestate. The names and addresses of the Petitioner and the personal representative's attorney are set forth below. Be advised that the fiduciary lawyer-client privilege in Florida Statute 90.5021 applies with respect to the Petitioner and any attorney employed by the Petitioner.
All persons of whom this notice is served and who have objections that challenge the validity of the will, the qualifications of the petitioner, venue, or jurisdiction of this Court are required to file their objections with this Court WITHIN THE LATER OF THREE MONTHS AFTER THE DATE OF THE FIRST PUBLICATION OF THIS NOTICE OR THIRTY DAYS AFTER THE DATE OF SERVICE OF A COPY OF THIS NOTICE ON THEM.
That persons who may be entitled to exempt property under Florida Statutes 732.402 will be deemed to have waived their rights to claim that property as exempt property unless a petition for determination of exempt property is filed by such persons or on their behalf on or before the later of the date that is 4 months after the date of service of a copy of the notice of administration on such persons or the date that is 40 days after the date of termination of any proceeding involving the construction, admission to probate, or validity of the will or involving any other matter affecting any part of the exempt property.
An election to take an elective share must be filed on or before the earlier of the date that is six (6) months after the date of service of a copy of the notice of administration on the surviving spouse, or an attorney in fact or a guardian of the property of the surviving spouse, or the date that is two (2) years after the date of the decedent's death.
Any interested person on whom a copy of the notice of administration is served must object to the validity of the will, the qualifications of the Petitioner, the venue, or the jurisdiction of the court by filing a petition or other pleading requesting relief in accordance with the Florida Probate Rules on or before the date that is 3 months after the date of service of a copy of the notice of administration on the objecting person, or those objections are forever barred.
NOTICE OF PERSONAL REPRESENTATIVE TAKING POSSESSION OF PROTECTED HOMESTEAD
YOU ARE HEREBY NOTIFIED THAT:
1. The name and address of the personal representative is set forth at the end of this notice.
2. On August 15, 2016, the personal representative took possession of the following described real property pursuant to Florida Statutes Section 733.608(2), pending a determination of its homestead status: 1025 Rose Garden Road, Cape Coral, FL 33914, more particularly described as: Lot 21, ROSE GARDEN SUBDIVISION, according to the map or plat thereof as recorded in Plat Book 60, Page 11-12, inclusive, in the Public Records of Lee County, Florida
Parcel Identification Number: 22-45-23-C2-00400.0210
3. The property referenced is believed to be “protected homestead” based upon Article X, IV of the Florida Constitution that would be determined by a Petition to Determine Homestead that is forthcoming.
4. The property is not occupied by any person who appears to have an interest in the property.
5. The Personal Representative took possession of the property referenced above for the limited purpose of preserving, insuring, and protecting it for the person having an interest in the property.
6. At the time of the filing of the original petition, the decedent appeared to have no heirs as her body was in the possession of the funeral home for almost two months, an heir search resulted in no heirs, and notice having been duly published with the News-Press, and the Death Notice published on the internet for almost sixty (60) days.
7. Expenditures and obligations incurred for which the lien is imposed were incurred for the purpose of preserving, maintaining, or protecting the homestead property.
8. The Personal Representative has expended or is obligated to expend funds to preserve, maintain, insure, or protect the property and that the lien stands as security for recovery of those expenditures and obligations incurred, including fees and costs.
All persons of whom this notice is served and who have objections are required to file their objections with this Court WITHIN THE LATER OF THREE MONTHS AFTER THE DATE OF THE FIRST PUBLICATION OF THIS NOTICE OR THIRTY DAYS AFTER THE DATE OF SERVICE OF A COPY OF THIS NOTICE ON THEM.
