NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated August 1, 2016, entered in Civil Case No.: 11-2016-CA-000722-0001-XX of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein TOWD POINT MASTER FUNDING TRUST REO, BY U.S. BANK TRUST NATIONAL ASSOCIATION, AS TRUSTEE, Plaintiff, and JAMES C. RUSSO A/K/A JAMES RUSSO; LYNDA M. RUSSO A/K/A LYNDA RUSSO; 1ST CONSTITUTION BANK; POSITANO PLACE AT NAPLES IV CONDOMINIUM ASSOCIATION, INC.; POSITANO PLACE AT NAPLES MASTER ASSOCIATION, INC.; UNKNOWN TENANT(S) IN POSSESSION #1 N/K/A STEPHANIE WALKER; et al are Defendants.
I will sell to the highest bidder for cash, the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 AM, on the 3rd day of November 2016, the following described real property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT 302, BUILDING 400, POSITANO PLACE AT NAPLES IV, A CONDOMINIUM, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF RECORDED IN OFFICIAL RECORD BOOK 4014, PAGE 546, AS AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
