NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated October 6, 2016, and entered in Case No. 16-CA-001759 of the Circuit Court of the TWENTIETH Judicial Circuit in and for Lee County, Florida, wherein DEUTSCHE BANK TRUST COMPANY AMERICAS, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF DOVER MORTGAGE CAPITAL 2005-A CORPORATION, GRANTOR TRUST CERTIFICATES, SERIES 2005-A is the Plaintiff and MURIEL R. BURGE, LEE COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, GE MONEY BANK, UNKNOWN TENANT #1, UNKNOWN TENANT #2, JERRY L. BURGE, UNKNOWN SPOUSE OF JERRY L. BURGE, UNKNOWN SPOUSE OF MURIEL R. BURGE, and BANK OF AMERICA, N.A. the Defendants. Linda Doggett, Clerk of the Circuit Court in and for Lee County, Florida will sell to the highest and best bidder for cash at www.lee.realforeclose.com, the Clerk's website for on-line auctions at 9:00 AM on 7 day of November, 2016, the following described property as set forth in said Order of Final Judgment, to wit:
LOT 33, PONDELLA CIRCLE, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 12, PAGE 98, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
