NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 5th day of October 2016 and entered in Case No. 51-2014-CA-002327WS, of the Circuit Court of the 6TH Judicial Circuit in and for Pasco County, Florida, wherein BANK OF NEW YORK MELLON, F/K/A THE BANK OF NEW YORK, AS TRUSTEE, ON BEHALF OF THE HOLDERS OF THE ALTERNATIVE LOAN TRUST 2005-85CB, MORTGAGE PASS-THROUGH CERTIFICATES SERIES 2005-85CB is the Plaintiff and THIRD FEDERAL SAVINGS AND LOAN ASSOCIATION OF CLEVELAND; KATHLEEN FLAHERTY; PATRICIA FLAHERTY ;LINDA PASTORE A/K/A LINDA CANNIZZARO PASTORE; and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 30th day of November 2016 at 11:00 AM on Pasco County's Public Auction website: www.pasco.realforeclose.com, pursuant to judgment or order of the Court, in accordance with Chapter 45, Florida Statutes, the following described property as set forth in said Final Judgment, to wit:
LOT 39, BLOCK “E” CAPE CAY, UNIT 2, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 7, PAGE 45, OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
