NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated October 20, 2016, entered in Case No. 11-CA-053729 of the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida, wherein Onewest Bank, FSB, is the Plaintiff and Steven D. Byler a/k/a Steve Byler; Unknown Spouse of Steven D. Byler a/k/a Steve Byler; Tracy Byler; Unknown Spouse of Tracy Byler; if Living, Including any Unknown Spouse of said Defendant(s), if Remarried, and if Deceased, the Respective Unknown Heirs, Devisees, Grantees, Assignees, Creditors, Lienors, and Trustees and all other persons claiming by, through, under or against the named Defendant(s); Mortgage Electronic Registration Systems, Inc. as nominee for Mortgageit, Inc.; Capital One Bank (USA), N.A.; Triumph Partnerships, LLC; Portfolio Recovery Associates, LLC; Whether Dissolved of Presently Existing, together with any Grantees, Assignees, Creditors, Lienors, or Trustees of said Defendant(s) and all Other Persons Claiming by, through, under or against the named Defendant(s); Unknown Tenant #1; Unknown Tenant #2 are the Defendants, that I will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com, beginning at 9:00 AM on November 21, 2016, the following described property as set forth in said Final Judgment, to wit:

TOGETHER WITH A NON-EXCLUSIVE EASEMENT FOR INGRESS AND EGRESS OVER AND ACROSS THE EASTERLY 20 FEET OF THE NORTH ½ OF THE SOUTHEAST ¼ OF THE SOUTHEAST ¼ OF THE NORTHWEST ¼ OF THE SOUTHEAST ¼ OF SECTION 29, TOWNSHIP 43 SOUTH, RANGE 27 EAST AND TOGETHER WITH A NON-EXCLUSIVE EASEMENT FOR INGRESS AND EGRESS OVER AND ACROSS THE EASTERLY 20 FEET OF THE NORTH ½ OF THE SOUTHEAST ¼ OF THE SOUTHEAST ¼ OF THE NORTHWEST ¼ OF THE SOUTHEAST ¼ OF SECTION 29, TOWNSHIP 43 SOUTH, RANGE 27 EAST.
GRANTOR ALSO CONVEYS HEREIN A NON-EXCLUSIVE EASEMENT OVER THAT RIGHT OF WAY GRANTED TO GRANTOR HEREIN, IN THAT CERTAIN WARRANTY DEED DATED MAY 23, 1974, RECORDED IN O.R. BOOK 1038, PAGE 365, GRANTED TO GRANTORS PREDECESSOR IN TITLE BY THAT CERTAIN WARRANTY DEED DATED FEBRUARY 28, 1972 AND RECORDED IN O.R. BOOK 787, PAGE 80, PUBLIC RECORDS OF LEE COUNTY, FLORIDA. FURTHER DESCRIBED AS FOLLOWS: AN EASEMENT FOR INGRESS/EGRESS OVER AND ACROSS THE FOLLOWING: THE WESTERLY 60.00 FEET OF THE SOUTHEAST ¼ OF THE SOUTHEAST ¼ OF THE NORTHEAST ¼, SOUTH OF STATE ROAD 80; THE WESTERLY 60.00 FEET OF THE NORTHEAST ¼ OF THE NORTHEAST ¼ OF THE SOUTHEAST ¼; THE SOUTHERLY 60.00 FEET OF THE NORTHWEST ½ OF THE NORTHEAST ¼ OF THE SOUTHEAST ¼; AND THE SOUTHERLY 60.00 FEET OF THE NORTHEAST ¼ OF THE NORTHWEST ¼ OF THE SOUTHEAST ¼, SECTION 29, TOWNSHIP 43 SOUTH, RANGE 27 EAST.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
