Notice is hereby given pursuant to the final judgment entered in the above noted case, that Ken Burke, Pinellas County Clerk of Court, will sell the following property situated in Pinellas County, Florida, described as:
All right, title and interest in the Proprietary Lease to Apartment No. 106, Building 26-E, Seminole Gardens Apartments, which is situated in Pinellas County, Florida, and which Lease has an expiration date of June 3, 2069, including any equity owned in said apartment or any assets of Seminole Gardens Apartments No. 26-E, Inc., and including any and all stock certificates issued by Seminole Gardens Apartments No. 26-E, Inc., in reference to said apartment located in Building 26-E described as follows:

From the NW corner of the NW 1/4 of Section 27, Township 30 South, Range 15 East, Pinellas County, Florida, run S. 00°10'41” W., along the West line of said Section, 580 feet; thence S. 89°49'19” E., 60 feet to the East right-of-way line of 113th Street; thence S. 00°10'41” W., along the said East right-of-way line, 1196.26 feet for a Point of Beginning; thence S. 88°09'15” E., 121.0 feet; thence N. 53°46'59” E., 67.06 feet; thence S. 88°09'15” E., 167.25 feet; thence S. 00°10'41” W., 175 feet; thence N. 88°09'15” W,. 342.25 feet to the East right-of-way line of 113th Street; thence N. 00°10'41” E., along said East right-of-way line 133.65 feet to the Point of Beginning, containing 1.27 acres, more or less.
TOGETHER WITH an easement for ingress and egress over the following described tract of land, to-wit: From the NW corner of the NW 1/4 of Section 27, Township 30 South, Range 15 East, Pinellas County, Florida, run S. 00°10'41” W., along the West line of said Section, 1909.91 feet; thence S. 89°49'19” E., 60 feet to the East right-of-way line of 113th Street for a Point of Beginning; thence S. 88°09'15” E., 810.32 feet; thence S. 00°10'41” W., 30 feet; thence S. 88°09'15” E., 60 feet; thence S. 00°10'41” W., 30 feet; thence N. 88°09'15” W., 870.32 feet to the East right-of-way line of 113th Street; thence N. 00°10'41” E., 60 feet along the said right-of-way line to the Point of Beginning.

SUBJECT to a drainage easement over the Northerly 5 feet and the Easterly 7.5 feet;
SUBJECT to a utility easement over the Northerly 5 feet and the Easterly 7.5 feet and over the Southerly 10 feet of the Northerly 15 feet of the Easterly 177.25 feet;
SUBJECT to a recreation easement over the Easterly 7.5 feet;

at public sale, to the highest and best bidder for cash in an online sale at www.pinellas.realforeclose.com, at 10:00 a.m. on October 14, 2016. The highest bidder shall immediately post with the Clerk, a deposit equal to 5% of the final bid. The deposit must be cash or cashier's check payable to the Clerk of the Circuit Court. Final payment must be made by 11:00 am EST on the next business day after the sale to the Clerk by cash or cashier's check.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
