NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure April 4, 2017, and entered in Case No. 12-CA-051435 of the Circuit Court of the 20th Judicial Circuit, in and for LEE County, Florida, where in WILMINGTON SAVINGS FUND SOCIETY, FSB, D/B/A CHRISTIANA TRUST AS OWNER TRUSTEE OF THE RESIDENTIAL CREDIT OPPORTUNITIES TRUST III, is the Plaintiff and TIMOTHY W. BAKER, EDA E. BAKER, UNKNOWN TENANT(S), are the Defendants, the Clerk of Court shall offer for sale to the highest bidder for cash on May 4, 2017, at 9:00 A.M., at www.lee.realforeclose.com, the following described property as set forth in said Summary Final Judgment lying and being situate in LEE County, Florida, to wit:
BEGINNING AT THE SOUTHWEST CORNER OF THE NORTHWEST QUARTER (NW 1/4) OF SECTION 26, TOWNSHIP 43 SOUTH, RANGE 24 EAST; THENCE RUN NORTH A DISTANCE OF 25 FEET; THENCE RUN EAST A DISTANCE OF 612.42 FEET; THENCE RUN NORTH A DISTANCE OF 1040 FEET TO THE POINT OF BEGINNING OF THE LANDS HEREBY CONVEYED;
THENCE NORTH A DISTANCE OF 80 FEET; THENCE WEST 203.22 FEET; THENCE SOUTH 80 FEET; THENCE EAST 203.16 FEET TO THE POINT OF BEGINNING OF THE LANDS HEREBY CONVEYED; LEE ALL OIL, GAS AND MINERAL RIGHTS AS SUCH RIGHTS ARE NOT OWNED BY THE GRANTOR HEREIN (SAME BEING LOT 78 OF COLLIER AND RUPERT'S UNRECORDED PLAT).
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale. THE CLERK SHALL RECEIVE A SERVICE CHARGE OF UP TO $70 FOR SERVICES IN MAKING, RECORDING, AND CERTIFYING THE SALE AND TITLE THAT SHALL BE ASSESSED AS COSTS. THE COURT, IN ITS DISCRETION, MAY ENLARGE THE TIME OF THE SALE. NOTICE OF THE CHANGED TIME OF SALE SHALL BE PUBLISHED AS PROVIDED HEREIN.
