NOTICE IS HEREBY GIVEN pursuant the Final Judgment of Foreclosure dated August 7, 2017, entered in Civil Case No.: 16-CA-002832, of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein WILMINGTON SAVINGS FUND SOCIETY, FSB, DOING BUSINESS AS CHRISTIANA TRUST, NOT IN ITS INDIVIDUAL CAPACITY, BUT SOLELY AS TRUSTEE FOR BCAT 2015-14BTT, is Plaintiff, and BELA TAR, is Defendant(s).
LINDA DOGGETT, Lee County Clerk of the Circuit Court & Comptroller shall sell to the highest bidder for cash at 9:00 a.m., at www.lee.realforeclose.com on September 14, 2017, the following described real property as set forth in said Final Summary Judgment, to wit:
A LOT OR PARCEL OF LAND LYING IN LOTS 60-B AND 61-B, OF THAT CERTAIN SUBDIVISION KNOWN AS FLORIDA GULF LAND COMPANY'S SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF LEE COUNTY, FLORIDA, IN PLAT BOOK 1, PAGE 59, AS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SECTION 5, TOWNSHIP 46 S, RANGE 25 E, THENCE RUN S 89°53'30” W ALONG THE NORTH LINE OF SAID SECTION 5 FOR 1242.5 FEET TO THE WESTERLY LINE OF A 100 FOOT WIDE FLORIDA POWER & LIGHT COMPANY RIGHT-OF-WAY AND THE POINT OF BEGINNING. THENCE S 19°59'10” E ALONG SAID RIGHT-OF-WAY LINE FOR 224.90; THENCE S 89°53'30” W FOR 295.13 FEET; THENCE N 0°06'30” W FOR 211.5 FEET TO THE NORTH LINE OF SAID SECTION 5; THENCE N 89°53'30” E ALONG SAID NORTH LINE FOR 218.66 FEET TO THE POINT OF BEGINNING . SUBJECT TO AND LESS THE NORTH 30.0 FEET THEREOF FOR ROAD RIGHT-OF-WAY AND FURTHER SUBJECT TO EASEMENTS, RESTRICTIONS AND RESERVATIONS OF RECORD.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
This Notice of Sale shall be published for two (2) consecutive weeks in the Business Observer.
