NOTICE OF PUBLIC HEARING AS TO ADOPTION OF
BRANDY CREEK SPECIAL ASSESSMENT ROLL
Pursuant to § 197.3632(4)(b), Fla. Stat., notice is hereby given that the City of Winter Garden City Commission will hold a public hearing in the City Commission Chambers at City Hall, located at 300 West Plant Street, Winter Garden, Florida on June 22, 2017 at 6:30 PM or as soon thereafter as possible to consider adoption of the following resolution for the levy of a special assessment and adoption of a special assessment roll:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER GARDEN, FLORIDA, RELATING TO THE FUNDING FOR THE INITIAL REPAIR AND RESTORATION OF THE STORMWATER AND DRAINAGE MANAGEMENT INFRASTRUCTURE AND SYSTEMS AND DRIVE AREAS LOCATED ON, ABOUT, OR WITHIN THE BRANDY CREEK SUBDIVISION; ESTABLISHING ANNUAL ASSESSMENTS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2017; APPROVING AN ASSESSMENT ROLL FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2017; ESTABLISHING THE LIEN ASSOCIATED THEREWITH; DIRECTING THAT THE ASSESSMENT ROLL BE CERTIFIED TO THE ORANGE COUNTY TAX COLLECTOR; PROVIDING FOR COLLECTION OF THE ASSESSMENTS PURSUANT TO FLORIDA'S UNIFORM ASSESSMENT COLLECTION ACT; AND PROVIDING FOR SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE.
A copy of the proposed resolution, which includes additional information concerning the affected parcels, may be inspected by the public between the hours of 8:00 AM and 5:00 PM, Monday through Friday of each week, except for legal holidays, at 300 West Plant Street. Amounts assessed pursuant to the Resolution shall be collected by the Orange County tax collector. The schedule for this Assessment is as follows:
A special assessment will be lawfully approved and permitted pursuant to Florida law by the City Commission of the City of Winter Garden and imposed upon the owners and members located within and about Brandy Creek subdivision, which special assessment shall be equal to two-thirds (2/3) of the costs of the stormwater and drainage improvements to be designed, permitted and constructed within and about Brandy Creek (“Improvements”), and the City intends to use the uniform method for the levy, collection, and enforcement of non-ad valorem special assessments, as authorized by § 197.3632, Florida Statutes, as amended, to collect funds to construct the Improvements located within and about Brandy Creek subdivision. The total estimated cost of such upgrades and repairs shall be apportioned over a period of twenty (20) years and collected annually and enforced in the same manner as provided for ad valorem taxes in the amount of $239.82 per parcel per year.
All property owners affected by the assessment referenced herein have the right to appear at the public hearing advertised herein and have the right to file written objections within 20 days of the publication of this notice. Interested parties may appear at the meetings and shall be heard with respect to the proposed resolution. Written comments will be accepted before or at the public hearing. Any persons wishing to appeal a decision of the City Commission with respect to any matter considered at the meeting and hearing advertised herein should ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which the appeal is to be based.
