NOTICE IS HEREBY GIVEN pursuant to order rescheduling foreclosure sale or Final Judgment, entered in Civil Case No. 2016-CA-003265 of the Circuit Court of the 10th Judicial Circuit in and for Polk County, Florida, wherein The Bank of New York Mellon as Trustee for CDC Mortgage Capital Trust 2004-HE3, Plaintiff and Robin Hightower Robinson are defendant(s), I, Clerk of Court, Stacy M. Butterfield, will sell to the highest and best bidder for cash at www.polk.realforeclose.com at 10:00 A.M. on July 11, 2017, the following described property as set forth in said Final Judgment, to-wit:
LOT 14, UNRECORDED TRACT DESCRIBED AS FOLLOWS: COMMENCE 356.00 FEET SOUTH OF THE NORTHWEST CORNER OF LOT 13, MCRAE & ROBSON ACCORDING TO PLAT BOOK 3, PAGE 54 OF THE PUBLIC RECORDS OF POLK COUNTY, FLORIDA, RUN THENCE EAST ALONG THE SOUTH RIGHT-OF-WAY LINE OF CARVER STREET 419.50 FEET TO THE POINT OF BEGINNING, CONTINUE THENCE EAST 75.00 FEET, THENCE SOUTH 145.00 FEET, THENCE WEST 75.00 FEET, THENCE NORTH 145.00 FEET TO THE POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
