NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated June 6, 2017, and entered in Case No. 16001366CA of the Circuit Court of the TWENTIETH Judicial Circuit in and for Charlotte County, Florida, wherein DEUTSCHE BANK TRUST COMPANY AMERICAS, AS TRUSTEE FOR THE HOLDERS OF THE DOVER MORTGAGE CAPITAL CORPORATION, GRANTOR TRUST CERTIFICATE SERIES 2004-A is the Plaintiff and STATE OF FLORIDA DEPARTMENT OF REVENUE, ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER OR AGAINST BILLY LEE CISSELL, SR., DECEASED, WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS , WENDY ZIMMERMAN, CHARLOTTE COUNTY CLERK OF COURT, BILLY LEE CISSELL, JR. A/K/A BILLY LEE CISSELL, AARON MICHAEL LEE CISSELL, KEVIN MICHAEL CISSELL, JOSEPH BARBIE, UNKNOWN TENANT #1 N/K/A JESSICA CISSELL, and STATE OF FLORIDA the Defendants. Roger D. Eaton, Clerk of the Circuit Court in and for Charlotte County, Florida will sell to the highest and best bidder for cash at www.charlotte.realforeclose.com, the Clerk's website for on-line auctions at 11:00 AM on 7th day of August, 2017, the following described property as set forth in said Order of Final Judgment, to wit:
LOTS 17 AND 18, BLOCK 12, TEE AND GREEN ESTATES, A SUBDIVISION ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 4, AT PAGES 18A THROUGH 18H, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORDS AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
