NOTICE OF PROPOSED AGENCY ACTION
The Florida Department of Environmental Protection (“Department”) gives notice that it proposes to approve Engineering and Institutional Controls and to issue a Site Rehabilitation Completion Order with institutional controls for a contaminated site. City of Winter Garden is seeking a Site Rehabilitation Completion Order with Conditions in reference to a portion of the Department Facility known as “City of Winter Garden/Former Grey Line Trucking”, Department Site ID # COM_239358, STCM No. 488512953, and the Brownfield Site Identification Number BF480201001, and intends to restrict exposure to contamination, through a Declaration of Restrictive Covenant, in the following manner:
* Use of the groundwater under the Restricted Property I and Restricted Property 2 (as defined in the draft restrictive covenant) shall be restricted, as further described in the draft restrictive covenant.
* The area of soil contamination located on the Restricted Property I has been permanently covered with an impermeable cap that prevents human exposure and prevents water infiltration (“Engineering Control”), as further described in the draft restrictive covenant.
* The Department has approved an Engineering Control Maintenance Plan (“ECMP”) which specifies the frequency of inspections and monitoring of the Engineering Control and the criteria for determining when the Engineering Control has failed.
* Any contaminated soils that are excavated from the Restricted Property I must be removed and properly disposed of in accordance with applicable law and the ECMP, as further described in the draft restrictive covenant.
Complete copies of the ECMP and the draft restrictive covenant, and the Department's preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays at FDEP - Central District, 3319 Maguire Blvd, Suite 232, Orlando, Florida 32803-3767.
Local governments, real property owner(s) of any property subject to the Institutional Control or Engineering Control, and residents of any property subject to the Institutional Control or Engineering Control have 30 days from receipt (or publication) of this notice to provide comments to the Department.
