NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated April 27, 2017, and entered in Case No. 16-CA-002705 of the Circuit Court of the TWENTIETH Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR TIIE CERTIFICATEHOLDERS OF CWALT, INC., ALTERNATIVE LOAN TRUST 2005-16, MORTGAGE PASS THROUGH CERTIFICATES, SERIES 2005-16 is the Plaintiff and UNKNOWN TENANT #2 N/K/A KELLY BRANDT, YAK LLC, A DELAWARE LIMITED LIABILITY COMPANY, UNKNOWN TENANT #1 N/K/A JULIA L. MAYS, BANK OF AMERICA, N.A., PEBLE BEACH AT LUGUNA LAKES ASSOCIATION, INC., ABNER HERRERA, UNKNOWN SPOUSE OF ABNER HERRERA, and LAGUNA LAKES COMMUNITY ASSOCIATION, INC. the Defendants. Linda Doggett, Clerk of the Circuit Court in and for Lee County, Florida will sell to the highest and best bidder for cash at www.lee.realforeclose.com, the Clerk's website for on-line auctions at 9:00 AM on 25 day of May, 2017, the following described property as set forth in said Order of Final Judgment, to wit:
UNIT 103, BUILDING K, OF PEBBLE BEACH AT LAGUNA LAKES, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 4211, PAGE 4187 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA AND ANY AMENDMENTS HERETO, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
