NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 10th day of May, 2017, and entered in Case No. 09013537CI, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein U.S. BANK TRUST, N.A., AS TRUSTEE FOR LSF9 MASTER PARTICIPATION TRUST is the Plaintiff and SAMY BESHIE A/K/A SAMY L. BESHIE; BANK OF AMERICA, N.A. C/O CT CORPORATION SYSTEM; CAROLINA FIRST BANK F/K/A MERCANTILE BANK; HOMEOWNERS ASSOCIATION OF WINDWARD POINTE CONDOMINIUM, INC.; BRANCH BANKING AND TRUST COMPANY, ITS SUCCESSORS OR ASSIGNS; and UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. KEN BURKE as the Clerk of the Circuit Court shall sell to the highest and best bidder for cash, on the 29th day of June, 2017, at 10:00 AM on Pinellas County's Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
UNIT NUMBER 140, BUILDING NUMBER 21, WINDWARD POINTE CONDOMINIUM, A CONDOMINIUM AND AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, EASEMENTS, TERMS AND OTHER PROVISIONS OF THE DECLARATION OF CONDOMINIUM AS RECORDED IN OFFICIAL RECORDS BOOK 5206, PAGE(S) 1985 THROUGH 2108, AS AMENDED; AND THE PLAT THEREOF RECORDED IN CONDOMINIUM PLAT BOOK 51, PAGE(S) 106 THROUGH 136, BOTH OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
