NOTICE IS HEREBY GIVEN pursuant to order rescheduling foreclosure sale or Final Judgment, entered in Civil Case No. 2017-CA-000492 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein HSBC Bank USA, National Association as Trustee for Merill Lynch Mortgage Investors, Inc., Mortgage Pass-Through Certificates, MANA Series 2007-OAR5, Plaintiff and Oaks at Whiskey Creek Condominium 3 Association, Inc. are defendant(s), I, Clerk of Court, Linda Doggett, will sell to the highest and best bidder for cash BEGINNING 9:00 A.M. AT www.lee.realforeclose.com IN ACCORDANCE WITH CHAPTER 45 FLORIDA STATUTES on November 20, 2017, the following described property as set forth in said Final Judgment, to-wit:
UNIT 414, BUILDING 4, OAKS AT WHISKEY CREEK CONDOMINIUM 3, PHASE 1, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF RECORDED IN INSTRUMENT NO. 2007000174176, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO, AS AMENDED FROM TIME TO TIME, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
