NOTICE OF PRESERVATION OF DECLARATION OF
COVENANTS, CONDITIONS AND
RESTRICTIONS FOR
KIPPS COLONY ESTATES
KIPPS COLONY ESTATES HOMEOWNERS ASSOCIATION, INC., by and through its authority as allowed pursuant to the Governing Documents of the Association including the original Declaration of Covenants, Conditions and Restrictions recorded in the Public Records of Pinellas County, Florida, appearing in O.R. Book 6807 beginning at Page 1620, thereafter amended with the First Amendment to the Declaration recorded in O.R. Book 6928 beginning at Page 2210 and the Second Amendment to the Declaration recorded in O.R. Book 14034, beginning at Page 1515, files this Notice of Preservation of Declaration of Covenants, Conditions and Restrictions. Pursuant to Chapter 712, Florida Statutes, this Notice contains the following information regarding the Kipps Colony Estates Homeowners Association, Inc.:
1. Name of the Association: Kipps Colony Estates Homeowners Association, Inc.
2. Mailing Address of the Association: Terra Management Services, LLC, 14914 Winding Creek Court, Tampa, Florida 33613
3. Legal Description of the Land Affected by this Notice: See Exhibit A attached with the detailed legal description which was recorded with the original Declaration.
4. The Declaration of Covenants, Conditions and Restrictions as well as amendments thereto to be preserved are recorded in the Public Records of Pinellas County, Florida, appearing in O.R. Book 6807, Page 1620 with the First Amendment to the Declaration recorded in O.R. Book 6928, beginning at Page 2210 and the Second Amendment to the Declaration recorded in O.R. Book 14034, beginning at Page 1515.
5. Affidavit of Board Member attesting that the action has been brought to the Association's attention through a properly noticed meeting: See Affidavit attached as Exhibit B.

I, Robert Bauman, being duly sworn, certify that the following information is true:
1. I am the President of Kipps Colony Estates Homeowners Association, Inc.
2. Kipps Colony Estates Homeowners Association, Inc. (the “Association”) has taken action to ensure that the Declaration of Covenants, Conditions and Restrictions of Kipps Colony Estates recorded in Official Records Book 6807, beginning at Page 1620 of the Public Records of Pinellas County, Florida along with the First Amendment recorded in O.R. Book 6928, beginning at Page 2210 in the Public Records of Pinellas County, Florida and the Second Amendment to the Declaration recorded in O.R. Book 14034, beginning at Page 1515 recorded in the Public Records of Pinellas County, Florida that currently burdens the property of each and every member of the Association, retains its enforement status with regard to the affected real property.
3. To this end, the Association shall cause the notice required by Chapter 712, Florida Statutes, to be recorded in the Public Records of Pinellas County, Florida and that pursuant to the Governing Documents of the Association, a properly held meeting was scheduled before the Board of Directors of the Association to allow for approving the preservation of the Declaration of Covenants, Conditions, and Restrictions in the Public Record of Pinellas County, Florida, along with all amendments thereto.
4. Copies of the notification and all attachments being recorded are available through the Association pursuant to the Association's Governing Documents regarding official records of the Association.
5. I understand that I am affirming under oath to the truthfulness of the statements made in this Affidavit.
I hereby certify that this 24 day of July, 2018 appeared before me Robert Bauman as President of Kipps Colony Estates Homeowners Association, Inc., a Florida corporation not-for-profit on behalf of the corporation. The President is personally known to me or has produced Robert Bauman as identification.
