NOTICE is hereby given that, Crystal K. Kinzel, Clerk of the Circuit Court of Collier County, Florida, will on the 27 day of December, 2018 at 11:00 A.M., in the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112 in accordance with Chapter 45, F.S., offer for sale and sell to the highest and best bidder for cash, the following described property situated in Collier County, Florida, to wit:
A description for Unit 116R, a portion of Lot 116, Lely Country Club, Tanglewood 1 as recorded in Plat Book 13, Page 107, of the Official Records of Collier County, Florida. Said Unit 116R more particularly described by metes and bounds as follows: COMMENCING at the Southeasterly corner of said Lot 116; THENCE along the Southeasterly line of said Lot 116 and the Northwesterly right-of-way line of Lely Court, along a curve, concave to the Southeast, whose elements are: central angle of 24 degrees 27'40”, radius of 60.00 feet, arc length of 25.62 feet and a chord that bears North 09 degrees 21'20” East, 25.42 feet to the “POINT OF BEGINNING”; THENCE along the centerline of the common wall between Units 116L and 116R and its extensions, North 68 degrees 20'31” West, 130.00 feet to a point intersecting the Northwesterly line of said Lot 116; THENCE along the Northwesterly line of said Lot 116 and said Unit 116R along a curve, concave to the Southeast, whose elements are: central angle of 24 degrees 25'21”, radius of 190.00 feet, arc length of 80.99 feet to a chord bears North 33 degrees 50'48” East, 80.38 feet to a point; THENCE along the Northeasterly line of said Lot 116 and said Unit 116R, South 43 degrees 56'32” East, 130.00 feet to a point intersecting the Northwesterly right-of-way line of Lely Court; THENCE along the Southeasterly line of said Unit 116R and said Lot 116, also being the Northwesterly right-of-way line Lely Court, along a curve, concave to the Southeast, whose elements are: central angle of 24 degrees 28'18”, radius of 60.00 feet, arc length of 25.63 feet and a chord that bears South 33 degrees 49'19” West, 25.43 feet to the “POINT OF BEGINNING”.

Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
