NOTICE IS HEREBY GIVEN pursuant to a Consent Final Judgment of Foreclosure dated August 30, 2018, entered in Civil Case No.: 11-2017-CA-001761-0001-XX of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein U.S. BANK TRUST, N.A., AS TRUSTEE FOR LSF9 MASTER PARTICIPATION TRUST, Plaintiff, and JASON J. FOYE; MARC DAVIGNON; DONALD DELLA PORTA, JR. A/K/A DONALD DELLAPORTA, JR.; FAIRWAY PRESERVE AT OLDE CYPRESS CONDOMINIUM ASSOCIATION, INC.; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC. (MIN#1000157-00061171498); et al., are Defendants.
I will sell to the highest bidder for cash, in the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 AM, on the 10th day of January, 2019, the following described real property as set forth in said Final Judgment, to wit:
UNIT 132, FAIRWAY PRESERVE AT OLDE CYPRESS, A CONDOMINIUM, ACCORDING TO THAT CERTAIN DECLARATION OF CONDOMINIUM THEREOF AS RECORDED IN OFFICIAL RECORDS BOOK 3866, PAGES 4006 THROUGH 4127, INCLUSIVE, AS AMENDED, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TOGETHER WITH THE EXCLUSIVE RIGHT TO USE PARKING SPACE 237, AND TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
