NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order of Final Judgment. Final Judgment was awarded on December 18, 2017 in Civil Case No. 16-003833-CI, of the Circuit Court of the SIXTH Judicial Circuit in and for Pinellas County, Florida, wherein, BANK OF NEW YORK MELLON, F/K/A THE BANK OF NEW YORK, AS TRUSTEE, ON BEHALF OF THE HOLDERS OF THE ALTERNATIVE LOAN TRUST 2006-41CB, MORTGAGE PASS-THROUGH CERTIFICATES SERIES 2006-41CB is the Plaintiff, and MARK A. HUNTER; TODD A. HUNTER; JSS PROPERTY PROFESSIONALS, INC.; UNKNOWN SPOUSE OF MARK A HUNTER N/K/A JODY HUNTER; UNKNOWN SPOUSE OF TODD A. HUNTER; BELLEAIR FOREST GARDEN CONDOMINIUM ASSOCIATION INC.; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The Clerk of the Court, Ken Burke, CPA will sell to the highest bidder for cash at www.pinellas.realforeclose.com on February 20, 2018 at 10:00 AM EST the following described real property as set forth in said Final Judgment, to wit:
ALL THAT CERTAIN CONDOMINIUM SITUATE IN THE COUNTY OF PINELLAS AND STATE OF FLORIDA, BEING KNOWN AND DESIGNATED AS FOLLOWS:
THAT CERTAIN PARCEL CONSISTING OF APARTMENT D, BUILDING 1721, AS SHOWN ON CONDOMINIUM PLAT OF BELLEAIR FOREST GARDEN CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE CONDOMINIUM PLAT BOOK 29, PAGES 89 THROUGH 96, PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM FILED AUGUST 9, 1978 IN OFFICIAL RECORDS BOOK 4734, PAGES 133 THROUGH 174, TOGETHER WITH SUCH ADDITIONS AND AMENDMENTS TO SAID DECLARATION AND CONDOMINIUM PLAT AS FROM TIME TO TIME MAY BE MADE, ALL AS RECORDED IN THE PUBLIC RECORDS OF PINELLAS COUTNY FLORIDA; TOGETHER WITH THE EXHIBITS ATTACHED THERETO AND MADE A PART THEREOF; AND TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
