TO: UNKNOWN BENEFICIARY #1 and UNKNOWN BENEFICIARY #2, and any unknown spouse, heirs, devisees, grantees, creditors, or other parties claiming by, through, under, or against any known or unknown person who is known to be dead or is not know to be either dead or alive.
YOU ARE HEREBY NOTIFIED that a Complaint containing two (2) total counts has been filed. The first count is for declaratory judgment to establish the beneficiaries of the unrecorded land trust (the “trust”). A second count is brought to quiet title to the Property owned by the trustee of the unrecorded land trust, commonly known as, Unit 210 of the MacArthur Beach and Racquet Club of Venice, Florida and more particularly described as:
That certain Condominium parcel composed of Unit 210, and an undivided 1/100th share in those common elements appurtenant thereto, in accordance with and subject to the covenants, conditions, restrictions, terms and other provisions of the Declaration of Condominium of MAC ARTHUR BEACH & RACQUET CLUB, a condominium, and all Exhibits attached thereto, as recorded in Official Records Book 1041, pages 1549 through 1636, both inclusive, First Amendments thereto recorded in Official Records Book 1048,pages 43 through 60, both inclusive, and the Plat thereof recorded in Condominium Book 7, pages 37, 37A through 37F, both inclusive, Public Records of Sarasota County, Florida.
Subject to restrictions, reservations, easements of record, zoning, applicable governmental regulations and taxes beginning with the year 2017 (the “Property”)
MARY SUE O'NEILL, WILLIAM M. O'NEILL, JR., CINDA SUE O'NEILL NOFFKE, MELINDA O'NEILL BOLIN and PATRICK KEVIN O'NEILL are named as Co-Defendants.
All persons claiming to be unknown beneficiary or claiming an interest in the Property are required to serve a copy of your answer and your written defenses, if any, to the Complaint, on John J. Waskom, Esq., the Plaintiff's attorney, whose address is 2033 Main Street, Suite 500, Sarasota, FL 34237, on or before 3-27-18.
You must also file your original answer and written defenses, if any, with the clerk of the court, for Sarasota County, Florida, either before service on the Plaintiff's attorney or immediately thereafter; OTHERWISE A DEFAULT WILL BE ENTERED AGAINST YOU for the relief demanded in Plaintiffs' Complaint.
