NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure filed May 30, 2018 entered in Civil Case No. 16001426CA of the Circuit Court of the Twentieth Judicial Circuit in and for Charlotte County, Punta Gorda, Florida, wherein WILMINGTON SAVINGS FUND SOCIETY, FSB, D/B/A CHRISTIANA TRUST, NOT INDIVIDUALLY BUT AS TRUSTEE FOR HILLDALE TRUST is Plaintiff and RICKY E SMITH, ANITA WESTBROOK, PORTFOLIO RECOVERY ASSOCIATES, LLC AS ASSIGNEE OF WASHINGTON MUTUAL BANK, UNITED STATES OF AMERICA DEPARTMENT OF TREASURY, are Defendants, the Clerk of Court will sell to the highest and best bidder for cash at www.charlotte.realforeclose.com in accordance with Chapter 45, Florida Statutes at 11:00 AM on the 29th day of August, 2018 on the following described property as set forth in said Final Judgment:
The Westerly 150 feet of the Easterly 300 feet of the Northerly half of Lot 19, Block A, Town of Seaboard, W.A. McElya's Subdivision of Little Gasparilla Island, according to the plat thereof as recorded in Plat Book 1, Page 11, of the Public Records of Charlotte County, Florida, Together with and subject to a walkway easement over and across the Southerly 2 feet thereof. Less and Except the following described property: A portion of Lot 19, Block A, Town of Seaboard, W.A. McElya's Subdivision of Little Gasparilla Island, according to the plat thereof as recorded in Plat Book 1, Page 11, of the Public Records of Charlotte County, Florida, more particularly described as follows: Beginning at the Southwest corner of Lot 70, Plat of Gulf Estates, as recorded in Plat Book 7, Page 18, Public Records of Charlotte County, Florida; thence S 61 degrees 46'23” W, along the Northerly line of said Lot 19, Block A, a distance of 30.00 feet; thence S 28 degrees 13' 37” E, a distance of 10.00 feet to a line lying parallel to and 10.00 feet South of, as measured at right angles, to said Northerly line; thence N 61 degrees 46'23” E, along said parallel line, a distance of 40.00 feet; thence N 28 degrees 13'37” W, a distance of 10.00 feet to said Northerly line; thence S 61 degrees 46' 23” W, a distance of 10.00 feet to the point of beginning.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens, must file a claim within 60 days after the sale.
