NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order Resetting Sale entered on January 23, 2018 in Civil Case No. 52-2010-005062-CI, of the Circuit Court of the SIXTH Judicial Circuit in and for Pinellas County, Florida, wherein, HSBC BANK USA, N.A., AS TRUSTEE FOR THE REGISTERED HOLDERS OF NOMURA HOME EQUITY LOAN, INC., ASSET-BACKED CERTIFICATES, SERIES 2006-HE3 is the Plaintiff, and JOAN SMITH; BRIAN SMITH; FLORENCE M. FRANZ, AS A TRUSTEE OF THE FRANZ FAMILY TRUST AGREEMENT, UNDER TRUST DATED MAY 25, 1994; DONALD G. FRANZ, AS A TRUSTEE OF THE FRANZ FAMILY TRUST AGREEMENT, UNDER TRUST DATED MAY 25, 1994; UNKNOWN TENANT 1 N/K/A JOSEPHINE SPOSATO; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The Clerk of the Court, Ken Burke, CPA will sell to the highest bidder for cash at www.pinellas.realforeclose.com on March 27, 2018 at 10:00 AM EST the following described real property as set forth in said Final Judgment, to wit:
LOT 8, WOODGATE ESTATES, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 69 PAGE 77, PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA, LESS THE NORTHERLY PORTION THEROF BEING FURTHER DECRIBED AS FOLLOWS: BEGIN AT THE SOUTHWESTERLY CORNER OF SAID LOT 8 AND RUN NORTH 24 DEGREES 30' 00” WEST 200.13 FEET ALONG THE WESTERLY BOUNDARY OF SAID LOT 8 TO A POINT OF BEGINING; THENCE NORTH 76 DEGREE 37' 29” E, 198.82 FEET TO A POINT ON THE WESTERLY RIGHT OF WAY OF WOODGATE DRIVE; THENCE NORTH 08 DEGREES 26' 07” WEST 47.86 FEET ALONG THE SAID RIGHT OF WAY; THENCE SOUTH 66 DEGREES 24' 41” WEST 208.35 FEET TO A POINT ON THE WESTERLY BOUNDARY OF SAID LOT 8; THENCE SOUTH 24 DEGREES 30' 00” EAST 10.95 FEET ALONG THE WESTERLY BOUNDARY TO THE POINT OF THE BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
