NOTICE IS HEREBY GIVEN pursuant to the Final Judgment of Partition as to Count II, dated September 24, 2018, and entered in Case No. 2018 CA 000754 of the Circuit Court of the Twentieth Judicial Circuit in and for Charlotte, Florida, wherein FL PROPERTY MANAGEMENT 2, LLC, a Florida limited liability company, is Plaintiff, and EQUITY TRUST CO CUST IRA ACCOUNT, is Defendant, I will sell to the highest and best bidder for cash online at www.charlotte.realforeclose.com at 11:00 a.m. on the 29th day of October, 2018, all as provided by Chapter 45 of the Florida Statutes, the following described property as set forth in said Final Judgment, to wit:
COUNT II
Lot 5, Banyan Bayou, a Land Condominium on Little Gasparilla Island, also described as Unit 5 of Banyan Bayou Land Condominium, according to the plat thereof as recorded in Condominium Book 9, Page 37, and being further described in that certain Declaration of Condominium recorded in Official Records Book1079, Page 289, and Amended I Official Records Book 1113, Page 340, of the Public Records of Charlotte County, Florida, together with its undivided interest or share in the common elements appurtenant thereto and any amendments thereto.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
