Notice is given that pursuant to the Uniform Final Judgment of Foreclosure and Damages dated October 11, 2018, entered in Case No. 2018-CA-000159-CA-AX-WS of the Circuit Court of the Sixth Judicial Circuit in and for Pasco County, in which REGIONS BANK, is the Plaintiff, and SUNCOAST SMILE SAVERS, P.A., KENNETH E. MARTIN, a/k/a Ken Martin, HENRY SCHEIN, INC. and FORD MOTOR CREDIT COMPANY, are the Defendants, the Clerk of the Circuit Court will sell to the highest and best bidder for cash to be conducted in an online sale at www.pasco.realforeclose.com beginning at 11:00 a.m. on 28th day of November, 2018, in accordance with Chapter 45 Florida Statutes, the following-described property set forth in said Uniform Final Judgment of Foreclosure and Damages:
A portion of the Southwest ¼ of Section 16, Township 26 South, Range 16 East, Pasco County, Florida, being more fully described as follows:
For a Point of Reference commence at the Southwest corner of said Section 16, thence run North 00°33'01” East, along the Westerly boundary of said Southwest ¼, 799.94 feet; thence South 89°39'01” East, 30.00 feet to a point on the Easterly right of way line of Madison Street, as now established; thence North 00°33'01” East along said Easterly right of way line, 45.05 feet to the Point of Beginning; thence continue along said Easterly right of way line, North 00°33'01” East 147.52 feet, thence South 89°39'13” East, 214.33 feet to a point on the Westerly boundary of Cedar Pointe A Condominium, Phase II as shown on plat recorded in Plat Book 18, Page 33, 34, and 35 of the Public Records of Pasco County, Florida, thence South 00°20'59” West, along said Westerly boundary 147.58 feet to a point on the Northerly boundary of Cedar Pointe A Condominium, Phase I as shown on plat recorded in Plat Book 17, page 128, 129, 130 and 131 of the Public Records of Pasco County, Florida; thence along said Northerly boundary in a Southwesterly direction 23.56 feet along the arc of a 15.00 foot radius curve concave to the right having a chord that bears South 45°20'59” West; thence continue along said Northerly boundary North 89°39'01” West, 184.84 feet; thence continue along said Northerly boundary 23.61 feet along the arc of 15.00 foot radius curve concaved to the right having a chord that bears North 44°33'00” West, 21.25 feet to the Point of Beginning.
Together with each and every tenement, hereditament, easement, right, power, privilege, immunity and appurtenance thereunto belonging or in anywise appertaining, and any and all reversions, remainders, estates, rights, title, interests and claims of any Mortgagor, whatsoever, in law as well as in equity in and to all or any part of the foregoing (the “Lands”) and any and all buildings and other improvements now or hereafter located on any part thereof (the “Improvements”):
1.2 All fixtures now or hereafter located on the Lands or affixed to the Improvements (the “Fixtures”);
1.3 All insurance policies maintained with respect to any of the foregoing, including all proceeds thereof and any rights to any refund of premiums thereunder;
1.4 All rents, profits, issues, leases and revenues of any of the foregoing from time to time accruing whether under leases or tenancies now existing or hereafter created, together with all leases and rights under leases provided however that permission is hereby given to Mortgagor so long as there is no default hereunder, to collect, receive and use current rents no more than 30 days in advance;
1.5 All judgments, awards of damages and settlements hereafter made resulting from condemnation proceedings or the taking of any of the foregoing or any part thereof or of any right or privilege accruing thereto, including without limitation any and all payments from voluntary sale in lieu of condemnation or the exercise of eminent domain;
1.6 All proceeds, products and replacements of or accessions to any of the foregoing.
