NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated September 13, 2018, and entered in Case No. 362018CA000078A001CH of the Circuit Court of the TWENTIETH Judicial Circuit in and for Lee County, Florida, wherein Greenwood Credit Union is the Plaintiff and, ROBERT E. RAINVILLE A/K/A ROBERT RAINVILLE; THE GREENWOOD CREDIT UNION; CLERK OF COURT IN AND FOR LEE COUNTY, FLORIDA and WISTERIA POINTE SECTION I CONDOMINIUM ASSOCIATION, INC., A DISSOLVED CORPORATION OF THE STATE OF FLORIDA the Defendants. Linda Doggett, Clerk of the Circuit Court in and for Lee County, Florida will sell to the highest and best bidder for cash at www.lee.realforeclose.com, the Clerk's website for on-line auctions at 9:00 AM on 15 day of October, 2018, the following described property as set forth in said Order or Final Judgment, to wit:
UNIT 1208, BUILDING 12, PHASE 5, WISTERIA POINTE SECTION 1, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM, AND ALL ITS ATTACHMENTS AND AMENDMENTS, AS RECORDED IN OFFICIAL RECORDS BOOK 3370, PAGE 4206, AND AMENDMENTS THERETO, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA; TOGETHER WITH ALL APPURTENANCES THERETO, AND AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF THE SAID CONDOMINIUM.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
