notice is hereby given pursuant to an Order or Final Judgment of Foreclosure dated March 25, 2019, and entered in Case No. 2018-CA-002255 of the Circuit Court of the TWENTIETH Judicial Circuit in and for Collier County, Florida, wherein Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust, not individually but as trustee for Hilldale Trust is the Plaintiff and CARLOS H. ROUBICEK; ; ELENA M. ROUBICEK; MARK BATTEN; CITIBANK, N.A.; PATRICIA A. THRELKELD and PATRICIA A. THRELKELD, AS THE PERSONAL REPRESENTATIVE FOR THE ESTATE OF SHAYNE WILLIAM MURRAY, the Defendants. Crystal K. Kinzel, Clerk of the Circuit Court in and for Collier County, Florida will sell to the highest and best bidder for cash at in the lobby on 3rd floor of Collier County Courthouse Annex, 3315 Tamiami Trl E Naples, FL 34112 at 11:00 AM on 25 day of April, 2019, the following described property as set forth in said Order or Final Judgment, to wit:
LOT 8, BLOCK 321, MARCO BEACH, UNIT 9, A SUBDIVISION ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 6, PAGE 69-73, INCLUSIVE, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
If the sale is set aside, the Purchaser may be entitled to only a return of the sale deposit less any applicable fees and costs and shall have no further recourse against the Mortgagor, Mortgagee or the Mortgagee's Attorney.
