NOTICE OF SUPPLEMENTAL PRESERVATION OF USE RESTRICTIONS UNDER MARKETABLE RECORD TITLE ACT GATEWAY GREENS COMMUNITY ASSOCIATION, INC.

WHEREAS, Gateway Greens Community Association, Inc., a Florida corporation not-for-profit, (the “Association”), whose mailing address is c/o Alliant Property Management, LLC, 13831 Vector Ave, Fort Myers, Florida 33907, was created by the Developer, Westinghouse Gateway Communities, Inc., a Florida corporation, to operate and enforce the Declaration and General Protective Covenants for Gateway Greens Community; and
WHEREAS, pursuant to Chapter 712 of the Florida Statutes, entitled “Marketable Record Title Act,” the Board of Governors desires to preserve these restrictions; and
WHEREAS, the Association previously filed a Notice of Preservation of Use Restrictions Under Marketable Record Title Act Gateway Greens Community Association, Inc. (“Notice of Preservation”), recorded in the Official Records at Instrument Number 2018000057117, on March 9, 2018 in the Public Records of Lee County, Florida. The Notice of Preservation failed to include several restrictions, covenants, and easements which the Association desires to preserve; and

1. This Notice is being filed by Gateway Greens Community Association, Inc., the extension and preservation of the various Neighborhood Covenants and subsequent amendments thereto having been approved by at least the two-thirds (2/3) vote of the Board of Governors at a meeting of which the members of the Association were informed in accordance with Section 712.06, Florida Statutes. Said meeting was held on April 1st, 2019. An affidavit executed by Brian L Mook, the President of Gateway Greens Community Association, Inc., attesting that Notice of the Board of Governors meeting was mailed or hand delivered to members of the Association not less than seven (7) days prior to such meeting, along with a copy of said Notice, is attached hereto as Exhibit “A.”
