NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order Resetting Sale entered on January 23, 2019 in Civil Case No. 11-2016-CA-001708-0001-XX, of the Circuit Court of the TWENTIETH Judicial Circuit in and for Collier County, Florida, wherein, THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE BENEFIT OF THE CERTIFICATEHOLDERS OF THE CWABS INC., ASSET-BACKED CERTIFICATES, SERIES 2007-BC2 is the Plaintiff, and TOBIAS REAL ESTATE HOLDINGS, LLC; OSMIN ARCIA; YOSVANI MARTINEZ; ANNELISS MARTINEZ; UNITED STATES OF AMERICA, DEPARTMENT OF THE TREASURY - INTERNAL REVENUE SERVICE; BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHTHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The Clerk of the Court, Crystal K. Kinzel will sell to the highest bidder for cash in the lobby on the 3rd floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples FL 34112 on March 28, 2019 at 11:00 a.m. EST the following described real property as set forth in said Final Judgment, to wit:
THE EAST 75' OF TRACT 72, GOLDEN GATE ESTATES, UNIT 41, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 7, PAGES 26, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
