NOTICE IS HEREBY GIVEN pursuant to Summary Final Judgment of foreclosure dated January 17, 2019, and entered in Case No. 112018CA0016220001XX of the Circuit Court in and for Collier County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE, ON BEHALF OF THE HOLDERS OF THE HOME EQUITY ASSET TRUST 2005-1 HOME EQUITY PASS THROUGH CERTIFICATES, SERIES 2005-1 is Plaintiff and THE UNKNOWN SPOUSES, HEIRS, DEVISEES, GRANTEES, CREDITORS, AND ALL OTHER PARTIES CLAIMING BY, THROUGH, UNDER OR AGAINST THE ESTATE OF LAURA SPICER A/K/A LAURA MARIE STRICKLAND SPICER, DECEASED; PETER WEBB; MATTHEW WEBB; SARA SANACORA; BETTY SPICER; FERGUSON ENTERPRISES, INC.; ASSET ACCEPTANCE LLC; and ALL UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER OR AGAINST A NAMED DEFENDANT TO THIS ACTION, OR HAVING OR CLAIMING TO HAVE ANY RIGHT, TITLE OR INTEREST IN THE PROPERTY HEREIN DESCRIBED, are Defendants, I will sell to the highest and best bidder for cash the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112, 11:00 a.m., on February 14, 2019, the following described property as set forth in said Order or Final Judgment, to-wit:
THE SOUTH 165 FEET OF THE WEST HALF OF TRACT 20, SECTION 24, TOWNSHIP 49 SOUTH, RANGE 26 EAST, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 4, PAGE 34, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, LESS AND EXCEPT THE WEST 132 FEET THEREOF, SUBJECT TO ACCESS EASEMENTS OVER, ALONG AND ACROSS THE SOUTH 30 FEET AND THE EAST 30 FEET THEREOF.
THE WEST 132 FEET OF THE SOUTH 165 FEET OF TRACT 20, SECTION 24, TOWNSHIIP 49 SOUTH, RANGE 26 EAST, RECORDED IN PLAT BOOK 4, AT PAGE 34 OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA; SUBJECT TO AN ACCESS EASEMENT OVER, ALONG AND ACROSS THE SOUTH 30 FEET THEREOF.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
Pursuant to Florida Statute 45.031(2), this notice shall be published twice, once a week for two consecutive weeks, with the last publication being at least 5 days prior to the sale.
