NOTICE OF SALE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated March 6, 2019, and entered in Case No. 17-CA-002266 of the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida, wherein M&T BANK, is Plaintiff and JAMES R. AMADEI; WISTERIA POINTE SECTION I CONDOMINIUM ASSOCIATION, INC.; WISTERIA POINTE RECREATION ASSOCIATION, INC.; UNKNOWN SPOUSE OF JAMES R. AMADEI; UNKNOWN TENANT #1; UNKNOWN TENANT #2 are Defendants, the Office of Linda Doggett, Lee County Clerk of the Court will sell to the highest and best bidder for cash via online auction at www.lee.realforeclose.com at 9:00 A.M. on the 5 day of April, 2019, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM PARCEL: UNIT NO. 503, BUILDING NO. 5, OF PHASE 4, WISTERIA POINT SECTION I, A CONDOMINIUM, ACCORDING TO THE PLAT THEREOF AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM RECORDED IN O.R. BOOK 3370, PAGE 4206 ET SEQ., TOGETHER WITH SUCH ADDITIONS AND AMENDMENTS TO SAID DECLARATION AND CONDOMINIUM PLAT AS FROM TIME TO TIME MAY BE MADE AND TOGETHER WITH AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANTS THERETO, ALL AS RECORDED IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
and all fixtures and personal property located therein or thereon, which are included as security in the Plaintiff's mortgage.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
