NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated December 18, 2018, entered in Case No. 2018 CA 002287 NC of the Circuit Court of the Twelfth Judicial Circuit, in and for Sarasota County, Florida, wherein The Bank of New York Mellon, f/k/a The Bank of New York as successor in interest to JPMorgan Chase Bank, N.A. as Trustee for NovaStar Mortgage Funding Trust, Series 2006-2, NovaStar Home Equity Loan Asset-Backed Certificates, Series 2006-2 is the Plaintiff and Arlen B. Smith; Unknown Spouse of Arlen B. Smith; The Unknown Heirs, Devisees, Grantees, Assignees, Lienors, Creditors, Trustees, and all other parties claiming an interest by, though, under or against the Estate of Bernard R. Smith a/k/a Bernard Smith, deceased ; CACH, LLC are the Defendants, that Karen Rushing, Sarasota County Clerk of Court will sell to the highest and best bidder for cash by electronic sale at www.sarasota. realforeclose.com, beginning at 9:00 AM on the 17th day of April, 2019, the following described property as set forth in said Final Judgment, to wit:
BEGIN AT THE NE CORNER OF BLOCK “E” OF NEWTOWN TERRACE, AS RECORDED IN PLAT BOOK 4, PAGE 34, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA; THENCE N. 89 DEGREES 10 MINUTES WEST, ALONG THE NORTH LINE OF SAID BLOCK “E”, 90 FEET; THENCE S 0 DEGREES 30 MINUTES WEST 50 FEET FOR A POINT OF BEGINNING; THENCE CONTINUE SOUTH 0 DEGREES 30 MINUTES WEST ALONG THE WEST SIDE OF A 40 FOOT PRIVATE ROAD, A DISTANCE OF 100 FEET; THENCE N 89 DEGREES 10 MINUTES WEST 100 FEET; THENCE N 0 DEGREES 30 MINUTES E 100 FEET; THENCE N 89 DEGREES 10 MINUTES E 100 FEET TO THE POINT OF BEGINNING.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
