NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated October 24, 2019, entered in Civil Case No.: 11-2019-CA-000725-0001-XX of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWALT, INC., ALTERNATIVE LOAN TRUST 2005-31, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-31, Plaintiff, and CESAR R. MARTINEZ; SANDRA E. MARTINEZ; KEREN-TZUR GROUP, LLC; THE PRESERVE AT THE SHORES AT BERKSHIRE LAKES CONDOMINIUM ASSOCIATION, INC; THE SHORES AT BERKSHIRE LAKES MASTER HOMEOWNER'S ASSOCIATION, INC.; BANK OF AMERICA, NA; UNKNOWN TENANT(S) IN POSSESSION #1 N/K/A FELIPE ESTRADA, are Defendants.
I will sell to the highest bidder for cash, the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112 at 11:00 AM, on the 21 day of November, 2019, the following described real property as set forth in said Final Judgment, to wit:
UNIT 303, PH 3, OF THE PRESERVE AT THE SHORES AT BERKSHIRE LAKES, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 2594, PAGE 1409 AND AS AMENDED, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS DECLARED IN SAID DECLARATION OF CONDOMINIUM TO BE APPURTENANCE TO THE ABOVE DESCRIBED UNIT.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk before the clerk reports the surplus as unclaimed. If you fail to file a timely claim you will not be entitled to any remaining funds. After the funds are reported as unclaimed, only the owner of record as of the date of the Lis Pendens may claim the surplus.
