NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated Sept 17, 2019, entered in Civil Case No.: 19-CA-002742 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein MILL CITY MORTGAGE LOAN TRUST 2017-2, WILMINGTON SAVINGS FUND SOCIETY, FSB, D/B/A CHRISTIANA TRUST AS TRUSTEE, Plaintiff, and THE ESTATE OF WILLIAM L. MURRELL, DECEASED; UNKNOWN HEIRS, BENEFICIARIES, DEVISEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE ESTATE OF WILLIAM L. MURRELL, DECEASED; SOUTH POINTE VILLAS CONDOMINIUM, PHASE IV, ASSOCIATION, INC.; SOUTH POINTE VILLAS CONDOMINIUM MASTER ASSOCIATION, INC.; MARY RYAN MCCLARY A/K/A MARY R. COLLINS-CLAUSEN A/K/A DEBORAH COLLINS CLAUSEN; ALL OTHER UNKNOWN PARTIES, INCLUDING, IF A NAMED DEFENDANT IS DECEASED, THE PERSONAL REPRESENTATIVES, THE SURVIVING SPOUSE, HEIRS, DEVISEES, GRANTEES, CREDITORS, AND ALL OTHER PARTIES CLAIMING, BY, THROUGH, UNDER OR AGAINST THAT DEFENDANT, AND ALL CLAIMANTS, PERSONS OR PARTIES, NATURAL OR CORPORATE, OR WHOSE EXACT LEGAL STATUS IS UNKNOWN, CLAIMING UNDER ANY OF THE ABOVE NAMED OR DESCRIBED DEFENDANTS, are Defendants.
I will sell to the highest bidder for cash, www.lee.realforeclose.com, at 09:00 AM, on the 17 day of October 2019, the following described real property as set forth in said Final Summary Judgment, to wit:
CONDOMINIUM UNIT 30-D IN SOUTH POINTE VILLAS CONDOMINIUM, PHASE IV, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF AND EXHIBITS ATTACHED THERETO, RECORDED IN OFFICIAL RECORDS BOOK 1424, AT PAGES 1408 THROUGH 1456, BOTH INCLUSIVE, AND AS AMENDED THERETO, ALL OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA: TOGETHER WITH SUCH UNIT'S UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk before the clerk reports the surplus as unclaimed. If you fail to file a timely claim you will not be entitled to any remaining funds. After the funds are reported as unclaimed, only the owner of record as of the date of the Lis Pendens may claim the surplus.
