NOTICE OF PUBLIC HEARING
ON PROPOSED ENCROACHMENT POLICY AND
ENCROACHMENT REVIEW FEE
BY THE LAKESHORE RANCH COMMUNITY DEVELOPMENT DISTRICT
In accordance with Chapter 190, Florida Statutes, the Lakeshore Ranch Community Development District (the “District”) hereby gives notice of a public hearing to revise the policy for proposed encroachments upon District property, including common areas, driveway aprons and easements (the “Encroachment Policy”), and to establish an encroachment fee for review, processing and recording of encroachment agreements to allow residents to encroach upon District property in certain circumstances (the “Encroachment Review Fee”). Pursuant to Governor DeSantis' Executive Order 20-69 (as extended by Executive Order 20-193, and as it may be further extended or amended) relating to the COVID-19 public health emergency and to protect the public and follow the CDC guidance regarding social distancing, the public hearing on these policies and fees will be conducted by the Board of Supervisors of the District on Wednesday, September 9, 2020, at 6:30 p.m., at via telephonic and virtual technology.
The Board deems it necessary to hold the above-referenced meeting utilizing telephonic and virtual technology to conduct all necessary business properly coming before it. The District fully encourages public participation in its meeting in an orderly and efficient manner. The District will provide updates on its website, https://www.lakeshoreranch.net/, of any changes in how to participate as soon as possible.
The hearing will be for the purpose of reviewing and revising the Encroachment Policy to provide for a system of approval of encroachments by residents into District property; and establishing an Encroachment Review Fee to recover the costs relating to the review of such proposed encroachments. At the conclusion of the hearing, the Board expects to adopt the Encroachment Policy and the Encroachment Review Fee as finally approved by the Board of Supervisors.
The Florida Statutes being implemented include Chapter 190, Florida Statutes, generally, and Section 190.035, Florida Statutes, specifically; and provide legal authority for establishment of a fee schedule.
Pursuant to applicable requirements and guidance relating to COVID-19 the District will not provide any locations where communications media technology facilities will be available. To best facilitate public comments, participants are encouraged to submit questions or comments to the District Manager in advance of the meeting by email. The meeting is open to the public and will be conducted in accordance with the provisions of Florida law for community development districts and Executive Order 20-69. The meeting may be continued in progress without additional notice to a date, time, and place (either physical, telephonic, or virtual) to be specified on the record at the meeting.
