NOTICE OF PRESERVATION OF DECLARATIONS OF COVENANTS
AND RESTRICTIONS INCLUDING ALL AMENDMENTS THERETO OF
THE CALOOSA TRACE HOMEOWNERS
ASSOCIATION, INC.
The Caloosa Trace Homeowners Association, Inc. whose address is 7391 Bear Hollow Circle FORT MYERS, FL 33967,, has taken action to ensure that the Declaration of Covenants, conditions and Restrictions for Caloosa Trace recorded at Official Records Book 2134 at Page 4657 in the Public Records Lee County, Florida (“original declaration”) as amended from time to time, including, but not limited to all those certain amendments and supplements recorded at Official Records Book 2460 Page 2474 Public Records Lee County, Florida (Amendment 1), Official Records Book 2465 Page 0815 Public Records Lee County, Florida (Amendment 2), Official Records Book 2629 Page 0539 Public Records Lee County, Florida (Amendment 3), currently burdening the property of each and every member of the Association, retain their status as the source of marketable title with regard to the transfer of each and every member of the Association, retain their status as the source of marketable title with a garage in the transfer of the members residence and encumber each and every parcel and watt in the association as defined in the original declaration to wit:

TITLE ACTION
The Caloosa Trace Homeowners Association, Inc. whose address is 7391 Bear Hollow Circle FORT MYERS, FL 33967, has taken action to ensure that the Declaration of Covenants, Restrictions and Easements for Caloosa Trace recorded at Official Records Book 2134 at Page 4657 in the Public Records Lee County, Florida (“original declaration”) as amended from time to time, including, but not limited to all those certain amendments and supplements recorded at Official Records Book 2460 Page 2474 Public Records Lee County, Florida (Amendment 1), Official Records Book 2465 Page 0815 Public Records Lee County, Florida (Amendment 2), Official Records Book 2629 Page 0539 Public Records Lee County, Florida (Amendment 3), currently burdening the property of each and every member of the Association, retain their status as the source of marketable title with regard to the transfer of each and every member of the Association, retain their status as the source of marketable title with a garage in the transfer of the members residence and encumber each and every parcel and watt in the association as defined in the original declaration to wit:
A tract of land lying in the Northwest Quarter (N.W. ¼) of Section 9, Township 40 South, Range 25 East, Lee County, Florida, being more particularly described as follows:
Commencing at the Northeast corner of the Northwest Quarter (N.W. ¼) of said Section 9; thence run S. 1°02'50”E, along the east line of said Northwest Quarter (N.W. ¼) for 655.13 feet to the point of beginning. Thence continue S 1°02'50” E. for 1347.46 feet; thence run N 89°55'35”W for 1337.05 feet; thence run N 1°05'04”W. for 664.78 feet; thence run N 89°56'39”E. for 334.27 feet; thence run N 1°04'15” W. for 665.58 feet; thence run N 89°52'53” E. for 334.45 feet; thence run N 1°03'20”W for 12.60 feet; thence run N. 89°50'43”E. for 668.92 feet to the point of beginning.
AND
A parcel of land in the Northwest one-quarter if Section 9, Township 46 South, Range 25 East, more particularly described as follows:
Commence at the Northeast corner if the Northwest one-quarter of said Section 9, thence S. 1° 02' 50” E. along the east line of said Northwest one-quarter for 30.01 feet to an intersection with the South right-of-way line of Alico Road and the point of beginning of the herein described parcel of land; thence continue S. 1°02'50”E. along said East line for 605.13 feet; thence S. 89°50'43”W for 668.92 feet to an intersection with the East line of the Northwest one-quarter of the North-east one-quarter of the Northwest one-quarter of said Section 9; thence N. 1°03'20”W. for 603.97 feet to an intersection with the aforementioned South right-of-way line of Alico Road; thence N. 89°44'48”E. along said South right-of-way line 668.99 feet to the point of beginning, situate lying and being in Lee County, Florida.
The Association has caused the notice required by chapter 712, Florida Statutes, to be recorded in the Public Records of Lee County, Florida in accordance with section 712.06, Florida Statutes. Additionally, the Association has attached the Affidavit required by section 712.06(B), Florida statutes to this notice is Exhibit B. Copies of this notice and attachments and all documents described by your hands are available through the association, pursuant to the Association's governing documents regarding official records of the Association.
