NOTICE IS HEREBY GIVEN pursuant to an Amended Final Judgment of Foreclosure dated January 15, 2020, entered in Civil Case No.: 11-2019-CA-000731-0001-XX of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWALT, INC., ALTERNATIVE LOAN TRUST 2006-OC10, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-OC10, Plaintiff, and NICOLE A. PRATER; JASON A. PRATER; BRIAN LANDING AT THE ENCLAVE CONDOMINIUM ASSOCIATION, INC., are Defendants.
I will sell to the highest bidder for cash, the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112 at 11:00 AM, on the 13th day of February, 2020, the following described real property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT 8, BUILDING 25, BRIAR LANDING AT THE ENCLAVE CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 4022, PAGE 2050, AS AMENDED IN OFFICIAL RECORDS BOOK 4025, PAGE 1900, AND ANY AMENDMENTS THEREOF, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO, AS SET FORTH IN SAID DECLARATION.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk before the clerk reports the surplus as unclaimed. If you fail to file a timely claim you will not be entitled to any remaining funds. After the funds are reported as unclaimed, only the owner of record as of the date of the Lis Pendens my claim the surplus.
