NOTICE IS HEREBY GIVEN that pursuant to the Final Judgment of Foreclosure and Damages entered by the Court on October 18, 2019 and the Order Granting Plaintiff's Motion to Re-Set Foreclosure Sale entered by the Court on February 5, 2020 in Case No. 19-CA-829 of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, in which 2EE, LLC is the Plaintiff, and PROMENADE ON FIFTH LLC, PINNACLE ASSET TRUST, LLC, MYLES ALPERT, HARRY M. ZEA and ALISON ZEA, as Trustees, and MICHAEL MARINO, as Disinterested Trustee, of the Rohar Trust Dated July 12, 2011, THE ROCK CUSTOM HOMES, INC., and WILLIAM J. MUST, are Defendants, the Clerk of the Court, Crystal K. Kinzel, will sell to the highest and best bidder for cash on April 6, 2020, at 11:00 a.m. Eastern Standard Time (EST) in the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples FL 34112, the following described property, as set forth in said Final Judgment of Foreclosure, to wit:
All that part of Lots 1 and 2 of beaumaris Subdivision according to the Plat thereof, as recorded in Plat Book 4, Page 63, Public Records of Collier County, Florida, LEE and EXCEPTING therefrom the following described parcel:
Commencing at the Southwest corner of Lot 7 of Beaumaris Replat, according to the replat thereof as recorded in Plat Book 4, Page 107, Public Records of Collier County, Florida; thence along the Westerly line of said Lot 7 and along the Westerly line of Lot 6 of said Beaumaris Replat, North 0 degrees 07' 40” East 218 feet to the Southwest corner of Lot 5 of the Beaumaris Subdivision according to the plat thereof as recorded in Plat Book 4, Page 63, Public Records of Collier County, Florida; thence along the Westerly line of said Lot 5 of Beaumaris Subdivision, North 0 degrees 07' 40” East 104.09 feet to an angle point on the Westerly line of said Lot 5 of Beaumaris Subdivision; thence continue along the Westerly line of Lots 3 and 4 and said Lot 5 of Beaumaris Subdivision; North 33 degrees 48' 20” East 212.89 feet to the Southwest corner of Lot 1 of said Beaumaris Subdivision and the Point of Beginning of the parcel herein described;
Thence along the Westerly line of said Lot 1 of Beaumaris Subdivision, North 33 degrees 48' 20” East, 2.05 feet; thence South 58 degrees 18' 42” East and parallel with the South line of said Lot 1, a distance of 106.37 feet; thence North 31 degrees 40' 59” East 1.00 feet; thence South 58 degrees 19' 55” East 302.45 feet to the Easterly line of Lot 2 of said Beaumaris Subdivision; thence along said Easterly line of Lot 2, South 32 degrees 41' 40” West 3.16 feet to the South line of Lot 2 of said Beaumaris Subdivision; thence along said South line of Lot 2, North 58 degrees 18' 42” West, 408.84 feet to the Southwest corner of Lot 1 of said Beaumaris Subdivision and the Point of Beginning of the parcel herein described; and FURTHER LESS and EXCEPTING therefrom the following described parcel;

Commence at the Southwest corner of Lot 1 of said subdivision, thence along the West line of said Lot 1, North 33 degrees 27' 26” East, 159.81 feet to the beginning of a curve concave Southeasterly; thence continue along said Lot line the arc of said curve to the right, having a radius of 41.50 feet, a central angle of 87 degrees 47' 49”, an arc length of 63.59 feet, the chord for which bears North 77 degrees 21' 20” East to the North line of said Lot 1 and the end of said curve; thence along the North of said Lots 1 and 2, South 58 degrees 44' 45” East, 247.18 feet for a Point of Beginning thence continue along said North line South 58 degrees 44' 45” East, 107.57 feet to the Westerly mean high water line of the Gordon River; thence along said Westerly mean high water line the following courses:
South 16 degrees 09' 35” East, 0.70 feet; South 58 degrees 32' 35” East, 4.92 feet; South 31 degrees 40' 40” West, 2.51 feet to end said courses; thence North 58 degrees 44' 45” West, 112.98 feet; thence North 31 degrees 15' 15” East, 3.00 feet to the Point of Beginning.
All being a part of Lots 1 and 2 of Beaumaris Subdivision (Plat Book 4, Page 63) Collier County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim before the clerk reports the surplus as unclaimed. The Notice of Sale will be published in the Business Observer in Collier County.
