NOTICE OF RULE DEVELOPMENT REGARDING A RULE RELATING TO TRAFFIC & PARKING ENFORCEMENT BY THE HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In accord with Chapters 120 and 190, Florida Statutes, the Harbor Bay Community
Development District (“District”) hereby gives notice of its intention to develop a Rule Relating to Traffic & Parking Enforcement to govern traffic and parking enforcement on District properties.
The Rule Relating to Traffic & Parking Enforcement will provide definitions; adopt a traffic and parking signage plan; prohibit parking at any time within roundabout islands; prohibit overnight parking in most areas, but allow it in other areas (specifically, Anchor Cove, Bay Breeze, Seacrest, and Landing Park) provided an overnight parking permit is obtained and displayed; defer to state and local laws within District rights-of-way; establish tow-away zones; provide for enforcement of the rule via towing and/or fines; provide for parking to be at one's own risk; preserve sovereign immunity; supersede all prior rules and policies established for traffic and parking enforcement; provide for severability; and reserve the Board's rights to future amendments and variances.
The purpose and effect of the Rule Relating to Traffic & Parking Enforcement is to provide for efficient and effective District operations and to repeal and replace all prior rules and policies established for traffic and parking enforcement, including but not limited to those set forth under Resolutions 2007-08 and 2010-14.
The specific legal authority for the adoption of the proposed Rule Relating to Traffic & Parking Enforcement includes Sections 120.54, 120.69, 190.011, and 190.012, Florida Statutes (2019). The specific laws implemented in the Rule Relating to Traffic & Parking Enforcement include, but are not limited to, Sections 190.011 and 190.012, Florida Statutes (2019).
A public hearing and Board meeting will be conducted by the District on June 18, 2020 at 6 p.m. It is anticipated that, due to the current COVID-19 public health emergency, this public hearing will be conducted remotely utilizing telephonic or video conferencing communications media technology pursuant to Executive Orders 20-52, 20-69, and 20-112 issued by Governor DeSantis on March 9, 2020, March 20, 2020, and April 29, 2020, respectively, and pursuant to Section 120.54(5)(b)2., Florida Statutes. If instead conditions allow the public hearing to occur in person, it will be conducted at the MiraBay Clubhouse, 107 Manns Harbor Drive, Apollo Beach, Florida 33572. Anyone wishing to access or participate in the Board meeting and/or public hearings should refer to the District's website http://harborbaycdd.org or contact Ms. Patricia Thibault, the District Manager, at [email protected] or by phone at (321) 263-0132 x4205 beginning seven (7) days in advance of the meeting and/or public hearing to obtain access information.
While it may be necessary to hold the above referenced public hearing utilizing communications media technology due to the current COVID-19 public health emergency, the District fully encourages public participation in a safe and efficient manner. Toward that end, participants are strongly encouraged to submit questions and comments to the District Manager by email at [email protected] by June 17, 2020 at 2:00 p.m. in advance of the public hearing to facilitate the Board's consideration of such questions and comments during the public hearing. Participants may also submit questions or comments to the District Manager by telephone by calling (321) 263-0132 x4205 by the same time noted above. Questions and comments may also be submitted by email after June 17, 2020 at 2:00 p.m. or submitted during the public hearing for potential consideration by the Board.
