NOTICE OF RULE DEVELOPMENT BY THE HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In accord with Chapters 120 and 190, Florida Statutes, the Harbor Bay Community
Development District (“District”) hereby gives notice of its intention to develop Amended and Restated Amenities Operating Rules, Rules for Amenities Rates, Disciplinary & Enforcement Rule and Amenity Forms (“Amended Amenity Rules and Rates”).
The proposed Amended Amenity Rules and Rates will address, among other things: (1) the requirements for the use of the District's facilities including but not limited to its fitness center, swimming pool, clubhouse facilities, athletic courts, boatlift, parks and other recreation facilities; (2) certain fees including an annual user fee, rental fees, proximity card and registration fees, guest pass fees, vehicle credential fees, and fees for programs, activities, services and goods; (3) a disciplinary and enforcement rule providing for, among other things, suspension of privileges and/or administrative fines as a result of a failure to comply with the rules and policies; and (4) forms for new patrons, a consent and waiver agreement, a credit application form, and a rental form.
The purpose and effect of the proposed rules and policies is to provide for efficient and effective District operations by setting policies, rates and fees to implement the provisions of Section 190.035, Florida Statutes. Specific legal authority for the rules includes Sections 190.035(2), 190.011(5), 120.54, 120.69 and 120.81, Florida Statutes.
A public hearing and Board meeting will be conducted by the District on June 18, 2020 at 6:00 PM p.m. It is anticipated that, due to the current COVID-19 public health emergency, this public hearing will be conducted remotely utilizing telephonic or video conferencing communications media technology pursuant to Executive Orders 20-52, 20-69, and 20-112 issued by Governor DeSantis on March 9, 2020, March 20, 2020, and April 29, 2020, respectively, and pursuant to Section 120.54(5)(b)2., Florida Statutes. Anyone wishing to access or participate in the Board meeting and/or public hearings should refer to the District's website at https://www.harborbaycdd.org or contact Patricia Thibault at [email protected], beginning seven (7) days in advance of the meeting and/or public hearing to obtain access information. If instead conditions allow the public hearing to occur in person, it will be conducted at the MiraBay Clubhouse, 107 Manns Harbor Drive, Apollo Beach, Florida 33572.
While it may be necessary to hold the above referenced public hearing utilizing communications media technology due to the current COVID-19 public health emergency, the District fully encourages public participation in a safe and efficient manner. Toward that end, participants are strongly encouraged to submit questions and comments to the District Manager at [email protected] by June 17, 2020 at 5:00 p.m. in advance of the public hearing to facilitate the Board's consideration of such questions and comments during the public hearing. Participants may also submit questions or comments to the District Manager by telephone by calling (321) 263-0132 X-4205, by the same time noted above. Questions and comments may be submitted by email after June 18, 2020 at 5:00 p.m. or submitted during the public hearing for potential consideration by the Board.
