Plaintiff hereby declares that Defendant owes Plaintiff the sum of $3,655.81, together with court costs, arising out of or as a direct result of the following facts to wit:
On 12-06-2019 the Plaintiff signed a Residential Lease with the Defendant for the apartment located at 4400 Beach Walk Dr. Unit 204 in Bonita Springs, Fl 34134 for a period of one year. The Defendant demanded a security deposit of $ 5.630. The Plaintiff can prove these payments with canceled checks numbers 5205 for $ 1,700, 5209 for $ 3,650 and 5210 for $ 280 The prorated December 2019 rent of $ 1,454.00 was also paid in advance on 12-06-19 by check 5207. The Defendant refused to supply the Plaintiff with a copy of the signed lease. Only after it was demanded by the Plaintiff's attorney did the Defendant supply a copy on 11-05-2020. Of the total deposit the Plaintiff used $1,700 for last month's rent (November2020) und for the first 5 days of December ($ 1700 / 31 = $ 54.84 x 5 days) =$ 274.19. The Plaintiff returned the leased property and the keys in a clean and undamaged condition on 12-05-2020. The Defendant did not make any claims for damages in the 30 days allowed for this purpose. The Plaintiff therefor demands the return of $ 5,630 less $1,974.19 (1700 + 274.19) = $3,655.81
