NOTICE OF RULEMAKING REGARDING RATE FOR REVIEW OF APPLICATIONS FOR BOAT LIFTS AND DOCKS FOR THE HARBOR BAY COMMUNITY DEVELOPMENT DISTRICT
In accord with Chapters 120 and 190, Florida Statutes, the District hereby gives the
public notice of its intent to adopt a rate for review of applications for boat lifts and docks (“Rate”).
A public hearing on the proposed Rate will be conducted by the Board of Supervisors of the Harbor Bay Community Development District (“District”) on September 16, 2021, at 6:00 p.m. at the MiraBay Clubhouse Lagoon Room, 107 Manns Harbor Drive, Apollo Beach, Florida 33572.
The public hearing will provide an opportunity for the public to address the proposed Rate. The purpose and effect of the proposed Rate is to provide for efficient and effective operation of district amenity facilities by setting out policies and terms for use, and to provide efficient District operations by setting fees to implement the provisions of Section 190.035, Florida Statutes. Prior notice of rule development was published in the Business Observer on August 6, 2021.
The proposed Rate for review of applications is $200 per application. Information pertaining to the proposed Rate may be obtained by contacting the District Office at c/o DPFG Management & Consulting, LLC, 250 International Parkway, Suite 280, Lake Mary, Florida 32746, Phone: (321) 263-0132.
Specific legal authority for the adoption of the proposed Rate includes sections 190.011(5), 190.011(15) and 190.035, Florida Statutes (2021).
The public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which such appeal is to be based. At the hearing, staff or Supervisors may participate in the public hearing by speaker telephone.
